The second is to analyze a variety of companies, their products, research and development (R&D) activities, and stock performance. Some companies consider themselves biotech, pharmaceutical, or biopharmaceutical depending on how their company operates. Moleculin Biotech, Inc. (MBRX) Market Cap: 35.07, current share price: 1.89, is a preclinical and clinical-stage pharmaceutical company focused on the development of game-changing anti-cancer drug candidates. Their lead drug candidate, Annamycin, is an anthracycline intended for the treatment of relapsed or refractory AML. The therapy is a combination of two chemotherapeutic drugs. On Monday, they announced they have signed a new technology license agreement with MD Anderson Cancer Center. This application intends to file a new patent for the treatment of relapsed or refractory acute myeloid leukemia.

Building & Realty Institute Event Features Speakers Touting Creative Infrastructure Financing

WHITE PLAINS, NY – 1 Aug, 2017 – Members of the Building & Realty Institute of Westchester and the Mid-Hudson Region (BRI) recently attended the organization’s recent event at The Crowne Plaza Hotel in White Plains.

Steve Otis, who serves in the New York State Assembly and is the former Mayor of Rye, spoke at the event about his past initiatives and current advocacy for clean water projects in Westchester County. Sabrina Ty, President of the New York State Environmental Facilities Corporation, discussed how various instructure projects were being supported around New York.

“In Westchester County and throughout the state, we have old water drinking systems where lead and other toxins are a big concern,” said Otis. “Also, many sanitary sewer and septic systems are straining their limits or are failing.”|

Funding clean water projects can be prohibitively expensive for municipalities. In Rye, Otis facilitated a new grant program in 2015 with the support of Governor Cuomo to make it more easier to finance these complicated projects. Through the state’s Environmental Facilities Corporation (EFC), municipalities are provided with “low cost financing for local wastewater and drinking water infrastructure.”

“It’s a critical situation that’s getting too expensive for municipalities to repair on their own and the EFC’s grant program and support services are key to making these necessary projects financially feasible and helping local governments meet 21st century water quality standards,” said Otis. “EFC is an agency functioning as a bank for local governments and they’ve implemented this program with a streamlined sense of innovation.”

In addition to offering low-cost capital funds and technical expertise for environmental projects  statewide, the EFC also administers the largest and most active revolving loan fund in the nation, managing more than $12 billion in assets, to help local governments meet modern health and environmental standards.

From 2011 through 2016, EFC has pumped $11.5 billion into infrastructure projects throughout the state and has generated roughly three-times that amount, around $32 billion, in regional economic activity and benefits, according to EFC President Sabrina Ty.

“Lending money to create opportunities for communities represents an innovation in investment and financing,” said Ty. “We have helped very large communities with $100 billion projects along with smaller improvements for just a million dollars, but this range illustrates our flexibility.”

Under proposals by the current presidential administration to slash the federal Environmental Protection Agency budget, Ty is uncertain about the EFC’s ability to continue to serve New York State at its current level of support.

“The EFC is the nation’s largest state revolving loan bank and largest appropriation in the federal EPA’s budget,” she said. “Regarding the proposed cuts to the EPA under the present Administration, how do you gut a third of the budget without cutting our EFC funding to the bone? Nobody knows how it will work out.”

Benicar Users Reach $300 Million Settlement with Daiichi Sankyo in National Litigation

CAMDEN, NJ – 1 Aug, 2017 – A Japanese pharmaceutical company, Daiichi Sankyo, will pay $300 million to settle thousands of federal and state court lawsuits over its top-selling blood pressure drugs, Benicar, Benicar HCT, Azor and Tribenzor, according to an announcement made today by the lead Plaintiffs’ lawyers in U.S. federal district court. 

The settlement was reached in the federal multidistrict litigation (MDL) case titled In re: Benicar (Olmesartan) Products Liability Litigation, MDL 2606, pending in the U.S. District Court for the District of New Jersey, Camden Division. The federal MDL litigation is assigned to the Honorable Judge Robert Kugler and the Honorable Magistrate Judge Joel Schneider, who oversaw the settlement negotiations.

The agreement reached by the parties is estimated to encompass approximately 2,500 claims by individuals who allege they have suffered severe and sometimes life-threatening gastrointestinal injuries while using medications containing the active ingredient olmesartan medoxomil (Benicar, Benicar HCT, Azor and Tribenzor).  Reports have linked Olmesartan to sprue-like enteropathy and celiac disease-like symptoms, gastrointestinal conditions that inhibit a person’s ability to absorb nutrients, due to changes in the intestinal tract, which appear similar to the changes seen with celiac disease. The litigation was resolved as the parties prepared for pre-trial hearings, and an anticipated first trial in federal court.

Christopher L. Coffin and Adam M. Slater, Co-Lead Counsel for the Plaintiffs in the national litigation, characterized the settlement as an outstanding result for the Plaintiffs. “We are very pleased with the outcome of this hard-fought litigation. This is a gratifying resolution for thousands of patients who suffered severe gastrointestinal injuries while using these blood pressure medications,” said Coffin.

The settlement was negotiated by the Plaintiffs’ Negotiating Committee comprised of Troy A. Rafferty of Levin, Papantonio, Thomas, Mitchell, Rafferty & Proctor, P.A.; Adam M. Slater of Maize, Slater, Katz and Freeman; Tara D. Sutton of Robins Kaplan L.L.P.; and Christopher L. Coffin of Pendley, Baudin & Coffin, L.L.P. On behalf of the Plaintiffs’ Negotiating Committee, Slater recognized the efforts of the numerous law firms from around the country who helped make the settlement possible: “This settlement is the product of hard work by many lawyers from around the country, and is a testament to the resources, teamwork and cooperation needed to successfully represent people in complex pharmaceutical litigation like this.”

Yuco Real Estate, HPD, BNY Mellon, CPC And Partners Celebrate The Completion Of Brook Avenue Apartments In The Bronx

BRONX, NY – 1 Aug, 2017 – Borough President, Ruben Diaz, Jr. and representatives from the NYC Department of Housing Preservation & Development, Bank of New York Mellon, First Sterling Financial, the Community Preservation Corporation and the Bronx Community Board recently joined with Yuco Real Estate Company to unveil a newly constructed affordable housing development in the Mott Haven neighborhood of the Bronx.

Brook Avenue Apartments consists of a two-building, 66-unit development constructed on vacant, formerly city-owned land. The 78,806-square foot project was built at a development cost of $24.4 million and was financed under Mayor Bill de Blasio’s Housing New York: A Five-Borough, Ten-Year Housing Plan. Its goal is to help address New York City’s affordability crisis by housing more than half a million New Yorkers, ranging from those with very low incomes to the middle class – all of whom face ever-rising rent pressures.

“Creating affordable housing units is very important to me and to our community, it is something I have been working on since Day 1 I became borough president,” Bronx Borough President Ruben Diaz Jr. “Since 2009, we have invested $1.6 billion towards the creation of over 6,100 affordable units across 68 projects, mostly for low-income families, and this project is testaments to the hard work we are putting in; alongside partners like Yuco Real Estate, who have shown a very strong commitment to work with our office, the residents and the neighborhood of Mott Haven, to make sure everyone has a fair shot at affordable housing.”

Borough President Diaz took a tour of the building and saw how each apartment had solid wood doors, solid wood kitchen cabinets and solid oak flooring. Granite kitchen countertops, GE appliances, Kohler bathroom fixtures, overhead lighting in each room and individual heating controls in each apartment were noted as well as how spacious and well designed the apartment units were.

Bong Yu, P.C. was both the engineering and architectural firm and Yuco Builders, LLC was the general contractor for the project. The Bank of New York Mellon, First Sterling Financial and the Community Preservation Corp. were the financial partners. 

The development includes two buildings – a five-story building located at 463 East 147th Street and a seven-story building located at 469 East 147th Street. The 463 address has 7 studio apartments, 35 one-bedroom apartments, 12 two-bedroom apartments and one three-bedroom apartment for a total of 55 units of affordable housing, inclusive of one two-bedroom superintendent unit. Thirteen of the total units in this building are affordable to households earning up to 40 percent of the Area Median Income (AMI), or an annual income of no more than $25,400 for an individual or $36,240 for a family of four. The remaining 41 units are affordable to households earning up to 60 percent AMI, or an annual income of no more than $38,100 for an individual or $54,360 for a family of four. This building also has an approximately 11,200 square-foot underground garage reserved for on-site parking and bicycle storage. The 469 address has 10 two-bedroom apartments and 1 one-bedroom apartment. Ten of the units in this building are affordable to households earning 60 percent AMI, or an annual income of no more than $38,100 for an individual or $54,360 for a family of four. The remaining unit is affordable to a household earning up to 40 percent AMI, or an annual income of no more than $25,400 for an individual or $36,240 for a family of four. This building has approximately 1,700 square-feet of commercial space. The development benefits from the acquisition of underused air rights of neighboring one-story Con Edison facilities.  Residents will also have easy access to buses: Bx 15, Bx 17, Bx 19 and trains: 2, 5 and 6 subway lines and the apartments are in close proximity to Lincoln Hospital and The Opera House Hotel.

The New York City Department of Housing Preservation and Development (HPD) provided Low-Income Housing Tax Credits for $16.6 million in permanent tax credit equity financing. HPD also facilitated $2.7 million in subsidies and $1.2 million in Reso A funds. The Bank of New York Mellon was the construction lender for this project as well as tax credit purchaser. First Sterling Financial is the project’s tax credit syndicator.

HPD Commissioner Maria Torres-Springer said: “HPD relies on the ingenuity of its programs combined with the resourcefulness of its partners to create quality affordable housing for all New Yorkers. Our development partners were able to build more affordable housing in the Brook Avenue Apartments developments than previously possible by purchasing the air rights to the adjoining Con Edison properties. This is precisely the type of smart development we champion. I want to congratulate Yuco Real Estate, CPC, and all of our development partners on a job well done. Thanks to you, 66 households have an affordable place to call home.”
