Iowa Attorney General Publishes Misleading Article About Help Your Diabetes and Dr. J. Murray Hockings

DALLAS, TX – 3 Feb, 2017 – 

The Iowa Attorney General’s office omitted key facts in the misleading article they published about Help Your Diabetes and Dr. J. Murray Hockings. They have refused to print an addendum that includes the missing facts.

Let’s go through their article point by point and show all the misleading statements and what they omitted…

Misleading Statement #1
“…illegal consumer contracts…”

They state the contracts HYD used were illegal. Any person has the right to waive their right in any issue. For example, when someone gets arrested, they are given their Miranda Rights, stating, “you have the right to remain silent…”. Once being told this right by the officer, the person being arrested can waive this right and talk to the officer. Regarding the contracts used by HYD, each patient voluntarily waives their right of rescission or ability to cancel, which is their right. Patients are not forced to do this. They have the option of not joining the program and not paying any money, however, the two patients referred to in their article where both explained their rights and agreed to waive their rights and signed contracts stating they agreed to waive their rights. Nothing illegal was done. The Iowa AG’s office didn’t agree with HYD’s policy.

Misleading Statement #2
“…refused $4,000 refunds to two older Iowans…”

HYD did initially refuse to refund the two patients in question because both had signed contracts stating they agreed to waive their right to cancel. HYD provided copies of the contracts to the Iowa AG’s office, but even though they saw the signed agreements, they came to the conclusion they didn’t agree that someone had the right to waive their right to cancel. HYD could have gone to court and have an expensive fight to prove their contracts are legal, but they are aware that in any lawsuit, the only people who win are the attorneys. HYD chose to avoid a lengthy and costly legal battle they would have surely won and decided to refund both patients. The Iowa AG’s office omitted the fact that both patients were refunded 100% of what they paid HYD. Refusing to include this fact is very misleading and makes it look like HYD still hasn’t refunded the two patients. When HYD asked the Iowa AG’s office to publish an addendum that disclosed these facts, their response was “Our office does not negotiate the contents or any other aspect of press releases, public statements or the like, and therefore we decline your request to issue an addendum regarding refunds provided to Iowa consumers.” Anyone can call the Iowa AG’s office to verify that both patients were refunded in full at (515) 281-6774.

Misleading Statement #3
“…can’t force them to to give up.”

No one was forced to give up their rights. They were explained their rights and they voluntarily chose to waive them and signed a contract stating that. They could have easily chosen not to sign the contract like many people in the past have. Patients attend a free 90 seminar explaining how bad diabetes is and how HYD can help reverse it. Seminar attendees are given the choice at the end of the seminar to have a consultation the next day with Dr. Hockings for $125. Typically over 85% of the attendees choose not to have a consultation. They choose. Once patients see Dr. Hockings for the consultation, they are given the option of joining the HYD program. Again, they get to choose. Many people choose not to join, but the ones who do join sign a contract stating they waive their right to quit the program. The choose. HYD has this policy because with any lifestyle change, if you want to get results, you need to stick with it and not quit. Dr. Hockings makes it very clear in his seminar and during the consultation that if you can’t stick with the program then it would be better for you not to even start because you won’t get results. It is better for the patient when they know they can’t quit and must stick with the program. All patients who join understand that, which is why they willingly sign the contract. Occasionally there will be patients, like the two in question, who go back on their word and their signed contract and still decide to quit. When this happens, HYD has the right to refuse the refund due to the contract they signed and they know that when a patient quits, they won’t get better or get any results, which is worse for them in the long run.

Misleading Statement #4
California Board issue.

The Iowa AG omitted the fact that the patients in the California article were completely refunded. Initially HYD refused to refund them due to the same reasons as above, but decided to refund them to avoid a legal battle and expense, just like above. They also omit the fact that Dr. Hockings has been licensed since 1992 and in all that time has only two fines against him by the board for $500 each, both of which wouldn’t have been necessary to pay if he chose to fight the complaints in court.

Misleading Statement #5
“…high pressure sales pitches…”

The presentation Dr. Hockings gives is not high pressure at all. It is a free seminar, consultation the next day and then patients choose if they want to join the HYD program. At no time is high pressure used and patients can choose not to have a consultation or join the program at any time.

Misleading Statement #6
“Resist the high pressure sales pitch to act now, get everything in writing and take all the time you need to check on the product or service that someone is trying to sell you.”

No one at HYD seminars are pitched to act now. They get to choose to see Dr. Hockings the next day or do a phone consultation anytime after that. They can join the program the next day after having a consultation or they can wait and call HYD back anytime and get the same price. There is never any pressure to join right away. Everything HYD says is in writing and patients sign contracts to ensure everything is crystal clear between both parties. Suggesting HYD uses high pressure tactics, pitches people to act now, doesn’t allow people all the time they need and doesn’t give everything in writing is completely false.

The AG’s office article has mislead Iowan’s by omitting key facts and in the process, damaged the reputation of HYD and Dr. Hockings. The AG’s office was given the opportunity to publish an addendum correcting the omissions, but they refused. Dr. Hockings has been helping diabetics since 1991, is a published author, had a documentary done on HYD that aired on Discovery Health Channel, has been interviewed on all the major TV networks, had a full page article on HYD run in USA Today newspaper, has a case study done on the HYD program that proves it actually reverses Type 2 Diabetes, has an abundance of patient testimonials showing how people have been able to reverse their Type 2 Diabetes, has a national medical director, has a medical advisory board and has a celebrity that endorses their program.

The Stationery Company has provided this long-lost art of the letterpress, embossing, and custom wedding invitations for 34 years, and will be celebrating its anniversary on February 1st. The door rings from a bell attached to the top as you open it and the soft scent of gardenia and jasmine greets you as paper, lots of paper, trigger memories of the excitement of sending someone a physical letter in the mail.

Lin Logan, the owner of The Stationery Company, gives us a tour of the small shop that is one of the last remaining stores in the city that offers handwritten addressed invitations in hand calligraphy, letter, embossed, and foil press with a wax seal.

When asked, what had been the biggest struggle over the past 34 years, Lin responded, “One of the biggest changes in our industry was the launch of the internet which gave way to E-Vites, E-Birthday cards and thank you notes. Many stationery companies could not survive. I can honestly say that because of our willingness to adapt while being true to our craft, we have been a reliable source for mothers to bring their daughters back when it was time for their wedding invitations, working with the Starky International Institute, a school that specializes in training household managers in the style of the English butler, being the go-to source of affiliates with the Denver Broncos, and announcing the L’Espirit de Noel Holiday House Tour.”

The original shop press is gone but a shadow box behind the counter contains a collection of memorabilia and photos of that press. Old techniques meet new as the two methods vie for the attention of the evolving market of wedding invitations, save-the-dates, birth announcements, and social invitations on the ribbon wall in the “print room”.

George Bento 8A Florida College Football Recruit Receiving Interest from BCS & FCS Programs

Bento had been a star player on defense for Jensen Beach the previous season, starting on both sides of the ball since the 10th grade. He also started on all special teams and played Lacrosse at Jensen Beach.

When George Bento takes the football field this spring at 8A St. Lucie West Centennial High School in Port St. Lucie Florida a lot of major college football programs will be watching.

At nearly 6’3 and 240 pounds Bento is force of nature with a combination of strength and quickness not normally found in players of his size.

After two seasons at 6A Jensen Beach High School, Bento transferred counties by moving to the St. Lucie West community from Jensen Beach to play for the 8A St. Lucie West Centennial Eagles.

Bento had been a star player on defense for Jensen Beach the previous season, starting on both sides of the ball since the 10th grade.  He also started on all special teams and played Lacrosse at Jensen Beach.

During his junior football season, Bento turned into a defensive star, with 48 tackles, 15 tackles for a loss, 8 sacks, 20 quarter back hurries, 2 pass deflections and 1 forced fumble in just 9 games as primarily a defensive lineman.

His stats going into his senior year place him among the top returning defensive players in the area, a hot bed for college football recruits with players receiving scholarships from to college programs like Alabama, Miami, Florida, Michigan and many others.

Taking his talents to 8A St. Lucie West was a bold move that he hopes will help his football development as a high school player and a college football recruit.

St. Lucie West is one of the largest schools in the area and plays against some of the best schools in the state including power house schools Vero Beach, Ft. Pierce Central and Treasure Coast.

St. Lucie West hired former NFL player and St. Lucie West graduate Jamar Chaney to be the new head coach after the end of the 2016 season.  Chaney played college football at Mississippi State where he was an All SEC player and MVP of the Senior Bowl. He spent five years in the NFL playing for the Eagles, Falcons, Broncos & Raiders.

At St. Lucie West George will be moving to linebacker this spring under the guidance of Coach Chaney and his staff.

The move to linebacker for Bento is a testament to his athleticism.  Bento who runs a 4.85 forty yard dash and has a 4.45, 5-10-5 shuttle is quick for his size.  He also has a 30 inch vertical jump and a broad jump over 8’6”.

Bento is also very strong compared to elite high school standards with a 315 bench press, 405 squat and 245 power clean.  His strength numbers are only going to go up heading into his senior season.

At the college level Bento is projected to be a run stop linebacker or defensive end, he could also play interior defensive line or tight end on offense.  If he can progress and have success at linebacker in his senior year at St. Lucie West Centennial his recruiting interests are likely to rise gaining more interest at bigger programs.

There are over 40+ BCS & FCS football programs that have shown interest in Bento since his sophomore season.

He recently was invited by the University of Central Florida for a junior day.

Last fall after his junior season George was invited to an unofficial visit at Georgia Tech where he attended a game against Virginia and was able to take a tour of the football facilities and program.

Last summer before his junior season, George had the opportunity to attend the All Poly Football Camp near Salt Lake City, Utah.

George is of Polynesian ancestry on his Father’s side of his family and was able to connect with his Polynesian roots and participate in a great football camp with some of the top players in the country.

The camp was attended by over 100 college coaches and George did extremely well impressing coaches from schools like Utah, Colorado, Arizona State, Idaho, Hawaii and Fresno State.

He was able to make unofficial visits to Utah and Webber State on his trip to the All Poly camp.  He plans to attend the same camp next summer taking unofficial visits to Colorado, Colorado State, Colorado Mesa and Colorado State Pueblo.

He has also been contacted with letters and emails from Kansas, USC, Kentucky, Louisville, Cincinnati, Tulsa, Alabama Birmingham and many others.

Right now, Georgia Tech is at the top of his recruiting list but George is open to learning more about other schools and programs.

George was invited to participate in 2017 Nike Opening Regional in Florida in February.  He was also invited to the Blue Grey All American Combine and the NUC All American Combine.

His goal is to find the right program fit for his education and football.  George is interested in majoring in Communications and has a 3.0 GPA.

NEW YORK COURT SAYS DEUTSCHE BANK MUST PAY $110 MILLION FOR BREACH OF DERIVATIVES CONTRACT

NEW YORK, NY – 3 Feb, 2017 – On January 24, 2017, New York’s Appellate Division, First Department, affirmed a $93.9 million trial verdict in favor of Good Hill Partners, a Connecticut-based hedge fund, against Deutsche Bank, in a case involving credit default swaps.

After a five-day bench trial in 2015, Justice O. Peter Sherwood of the New York County Supreme Court awarded Good Hill:

• $22.1 million in damages for Deutsche Bank’s breach of a swap contract as a result of its failure to return Good Hill’s collateral,

• $3.75 million in attorneys’ fees, and

• $68 million in pre-judgment interest at the default rate, which continues to accrue during the appeal, bringing the current amount of the judgment to over $110 million.

This decision is a reminder that New York courts hold parties to the terms of their contracts.  The Appellate Division ruled that a party can negotiate for its own economic advantage, in compliance with the terms of its contract, without violating the duty of good faith. Like the trial court, the Appellate Division rejected Deutsche Bank’s argument that Good Hill had breached the swap agreement or violated its duty of good faith  when it sold certain mortgage-backed securities to Bank of America. Bank of America subsequently undertook action that resulted in a payout to Deutsche Bank under the swap agreement in an amount less than what Deutsche Bank expected.  

In so ruling, the Appellate Division held that the terms of the standard ISDA contract form used in the swap trade allowed Good Hill to trade in the underlying securities and did not alter the common law obligations of a party to act in good faith.

The crux of the ruling is that a party may negotiate with third parties at arm’s length for its own advantage without violating the duty of good faith and fair dealing, even if the transaction has an adverse effect on the counterparty to the swap contract.

The Appellate Court also affirmed the lower court’s ruling that both pre- and post-judgment interest accrued at the default rate of 21% as per the parties’ agreement from the time the breach occurred in 2009. The amount of pre-judgment interest awarded appears to have been one of the largest amounts, if not the largest, ever awarded by a New York court in a breach of contract action.

Building a Bipartisan Bridge with Housing for the Elderly

TURLOCK, CA – 2/3/2017 /EASY NEWSWIRE/ — The U.S. Department of Housing and Urban Development (HUD) has never been a high-profile agency, but it now has a high-profile Secretary in renowned neurosurgeon and one-time presidential candidate Ben Carson. Some see Carson’s lack of experience in housing policy as a shortcoming.  But with no policy legacy to defend (and no political axes to grind), Carson is ideally positioned to champion the kind of creative, non-partisan, pragmatic solutions that low and moderate income Americans desperately need. 

In particular, Dr. Carson has a unique opportunity to change the landscape of urban and rural housing for the elderly. He can do this by demonstrating how housing and medical care clinics can be fused into a single solution to ensure that residents also have access to needed care. And to assist frail seniors, Dr. Carson should implement programs that provide “Care assistance workers” to allow them to maximize their independence.

The housing crisis facing American seniors is horrific. By 2024, the rapidly aging Baby Boomers will add roughly 9 million senior households with income under $30,000 to the demographic mix. Retirees are outliving their single-family homes and desperate to find affordable alternatives that for the most part don’t exist—an area of housing policy that the Trump Administration could champion to help middle class retirees.

A good place to start would be reviving HUD’s Section 202 program, which was gutted by Congress in 2011.  This public-private partnership used capital grants and rental assistance to boost private construction of affordable housing for seniors.  At its peak, the program created 20,000 units per year, and more than 250,000 of these units continue to provide housing for older adults.

Shutting down Section 202 widened a growing gap in affordable housing options for seniors.  As of 2011, 3.9 million low-income older adults were eligible for housing assistance, but only 1.4 million actually received it. Wait times for assisted senior housing now stretch past 2 to 3 years, and shortages will only deepen and wait times will only lengthen from here.

A creative revival of Section 202 would allow the Trump Administration to address three inter-connected challenges, and demonstrate how changing the urban and rural housing landscape can also boost economic development by creating new jobs in the building and construction trades and  necessitating a whole new army of care workers to help these elderly and disabled Americans remain independent.

First, a revitalized Section 202 would meet the affordable housing needs for millions of American seniors. Roughly 30 percent of older renters and 23 percent of those with mortgages spend more than half their income on housing, putting immense pressure on household finances, raising the specter of homelessness and jeopardizing access to necessities like medical care and food.

Section 202 would meet this demand by encouraging private construction of affordable homes designed around the unique needs of older adults. Such homes can be difficult to find – 40 percent of housing in the U.S. lacks basic accessibility features like no-step entry and single-floor design. A Section 202 community also combats social isolation, decreasing the risk of memory loss, stroke, and heart disease.

Second, a revived Section 202 program would enable older adults to receive care at home:  the cheaper and preferred option to meet care needs. Nearly 70 percent of adults over 65 will require assistance to care for themselves at some point, and professional in-home care is half as expensive as a room in a nursing home. Given that 90 percent of seniors say they want to live at home for as long as possible, Section 202 housing could grant this wish for hundreds of thousands of older Americans, who would otherwise be forced to choose between no care or more expensive, publicly provided care.

Third, by increasing access to care at home, a new Section 202 program would help reduce overall healthcare costs.  As America ages, Social Security and Medicare expenditures are projected to grow from 8 percent to 12 percent of GDP by 2050. The affordable housing/care at home combination can help reduce the pinch of these increases. 

Currently, just 13 percent of care at home is financed by government, compared to 60 percent of nursing home care. Care at home would also help to reduce costly hospitalizations resulting from inconsistent levels of care and medical emergencies. In 2008 alone, it’s estimated the U.S. saved as much as $25 billion in hospital costs due to the growth of care at home.

A revived Section 202 program is exactly the kind of non-partisan, forward-looking, common sense solution that older adults need and Americans of all parties want to see out of Washington.  And for a new Administration coming into office at historic lows, it allows Dr. Carson and President elect Trump to reach across the aisle and demonstrate forward thinking, and demonstrate to middle-class retirees that their President is listening.
