HELLAS CONSTRUCTION TEAMS UP ON USS ARIZONA MALL MEMORIAL AT UNIVERSITY OF ARIZONA

AUSTIN, TX – 12/8/2016 (PRESS RELEASE JET) — Hellas Construction is proud to have been a part of the construction of the USS Arizona Mall Memorial, located on the University of Arizona campus in Tucson, AZ that was dedicated Sunday.  The University of Arizona has a great tradition of remembering the USS Arizona and the eight military members from Arizona that were aboard when the Japanese bombed Pearl Harbor on December 7, 1941, 75 years ago today. During the dedication ceremony, hundreds gathered at UA to honor the lives that were lost that day. Names of the 1177 officers and crewmen that were killed aboard the ship at Pearl Harbor were read as the ship’s bell was tolled.

The tradition of honoring the USS Arizona at UA goes back to the 1950’s, when UA acquired one of the original ship’s bells, which hangs in the clock tower today. There is a sculpture, a memorial fountain, and a special collection of historical items as well at the university that honor the USS Arizona. 

The newest memorial features a 97 ft. by 597 ft. curved, brick wall that represents the ship bridge with concrete panels that display gold medals with the names of all 1177 officers and crewmen that were killed on the ship during the Pearl Harbor bombing. The wall spans across the midway point of the ships outline. The memorial was designed by David Carter and used Accella materials. Hellas Construction teamed up with Accella and installed the large, full-size frame outline of the ship in a large grassy mall area of the University of Arizona.

The USS Arizona was a super-dreadnought battleship built for the U.S. Navy just before World War I in the mid 1910’s. It was named after the 48th state that joined the union of the United States in 1912. It remained stateside during WWI, until escorting President Woodrow Wilson to the Paris Peace Conference in 1919, formally ending WWI and starting the path to the formation of the League of Nations. Years later it was transferred to the Pacific Fleet on the coast of California. It was used for training between the wars and provided aid to survivors when the 1933 earthquake struck Long Beach, CA. In 1935, it was also featured in the James Cagney film “Here Comes the Navy”. In 1940 it was transferred to Hawaii to act as a deterrent to Imperial Japan. It was bombed during the attack on Pearl Harbor, December 7, 1941, killing 1177 officers and crewmen, and was damaged so badly that it sunk to the bottom of Pearl Harbor where it still remains today. UA currently has a exhibition “The Life and Legacy of the USS Arizona” at Special Collections on campus.

Trump Settles with Relentless Southern California Attorney

“I settled the Trump University lawsuit for a small fraction of the potential award because as President I have to focus on our country,” Trump stated over a surely carefully-crafted tweet. Trump keeps a very active presence on Twitter, the social media platform, which is a first for one who has  held the position of Commander in Chief. Only a few days after winning the electorate in a shocking victory over Hillary Clinton, Trump has made tactical  efforts to wipe his slate as clean as possible so that none of his many pending legal matters might interfere with his task of taking over the presidency.

Both fraud and settling out of court are two things that Donald Trump has been no stranger to in the past, even before he decided to make his run for  the white house. Back in 2013 Donald Trump settled a lengthy dispute where he was mutually sued along with co-developers Jason Grosfeld and Adam Fisher, principals at Irongate Wilshire LLC.

Trump argued Grosfeld should shoulder 100% of the plaintiffs’ claims; 198 prospective buyers who claimed over $22 million in lost deposits when the project failed in 2008. Buyers who signed a contract with Trump-Irongate agreed to put down 30 percent of their unit’s inflated purchase price. Plaintiffs were represented by Daniel J. King, a tenacious trial lawyer with a long track record of high profile successes in the courtroom.

Trump had gone on record in an October 2006 interview that the Trump Organization would be a “significant” player, an equity investor in the over $200 million dollar project

The concept was a glitzy coastal condo-hotel-resort project along the Tijuana-Ensenada strip known as the Gold Coast. Following up their joint project on Waikiki Beach, Trump and Irongate joined forces to market the Trump Ocean Resort Baja, with Donald Trump’s face plastered all over marketing materials.  Trump had even made a promotional video for the Project with Donald, Jr. and daughter, Ivanka, who both touted their involvement, both claiming they’d purchased units themselves, which proved to be false.

Trump and Irongate both allegedly reported in numerous marketing materials that they had secured financing and permits for the project when in fact, unbeknownst to the buyers,  Tijuana’s Urban Development Department had no application on file for Irongate and Trump.

The furthest that Trump and Irongate were able to bring the process along before the project began to fail in 2008 was a well-dug hole in the ground. But if Trump was involved in putting a hole in the ground along the scenic Gold Coast, it must have been the most amazing hole to ever to be dug anywhere.

After all the “experts” and pundits told the defrauded buyers that they were simply out of luck, and that they would lose all their monies, Daniel King was able to figure out ways to go after Trump for violations of US federal statutes and to base his client’s case on blatant fraud. A  lengthy battle in the courts was ahead, with Trump refusing to settle throughout the battle.  Finally, after five years of brutal litigation, Trump himself finally settled with King and his buyer clients just before the Court was to set a hearing on Mr. King’s Motion for “Summary Judgment.”  The filing of this Motion put a substantial amount of pressure on Trump in that if the Motion had been successful, based on the  exhaustive and substantial evidence that proved to be overwhelming, the  Court would have rendered judgment against the Trump parties… even without trial.

With summary judgment looming, Mr. King was finally able to obtain a settlement from the Trump defendants on behalf of his victorious clients.

CNH Industrial (NYSE: CNHI) Sued for U.S. Antitrust Violations, Fraud, and Conspiracy in Financial Tying Arrangement

RACINE, WI – 12/8/2016 (PRESS RELEASE JET) — CNH Industrial America, LLC and its wholly owned subsidiary, CNH Capital America, LLC, have been sued for conspiring to monopolize portions of the U.S. agricultural wholesale equipment market and otherwise unduly terminate dealers in an allegedly unlawful wholesale financing tying arrangement.  

CNH Industrial (NYSE: CNHI) Sued for U.S. Antitrust Violations, Fraud, and Conspiracy in Forced Financial Tying Arrangement

The lawsuit, filed in the District Court of Oklahoma by New Holland dealer Wootton New Holland, LLC alleges that CNH Industrial and CNH Capital conspired to unlawfully perpetrate a scheme of fraud to circumvent The Fair Practices of Equipment Manufacturers, Distributors, Wholesalers, and Dealers Act of Oklahoma.

Specifically, the complaint alleges that CNH INDUSTRIAL and CNH CAPITAL acted to constructively and unlawfully terminate New Holland Brand Dealer Agreements by extinguishing lines of credit in an alleged “arm’s length” manner, while subsequently refusing to sell products and services to dealers on a cash basis or through other lenders. The complaint also alleges that the CNH Companies engaged in this conduct all while refusing to accept payment for orders in an effort to unlawfully retain payments due and owing to the dealers in order to reduce their own risk. The complaint further alleges that CNH Capital’s sole reason for existence is to circumvent dealer fair treatment statutes existing nationwide in the U.S..  The Plaintiff further alleges that CNH Industrial requires all dealers to purchase financing from CNH Capital at above market rates as a condition of sale and maintaining its dealer status with CNH Industrial.    

As the complaint explains, the CNH Entities division of functions between Industrial and Capital is “a design or scheme to perpetrate fraud.” Moreover, Capital “is so organized and controlled and its affairs so conducted that it is merely an instrumentality or adjunct of” CNH Industrial.  The complaint further explains that CNH Industrial has a history of engaging in illegally activity as part of their schemes to put dealers out of business. In Chili Implement Co., Inc. v. CNH America, LLC, 362 Wis.2d 540 (Wis. Ct. App. 2015),  a jury found that CNH lacked good cause to terminate its dealer, the Wisconsin Court of Appeals affirmed the jury’s finding and the Wisconsin Supreme Court refused to even entertain CNH’s final appeal.  After hearing the evidence, the jury found that CNH imposed nonessential and unreasonable requirements upon Chili Implement that unfairly discriminated against it as compared to other CNH dealers, then terminated its Dealer Agreement when Chili Implement was unable to comply with such nonessential, unreasonable and discriminatory requirements.  Id., 362 Wis.2d 540, *6. The Wisconsin Court of Appeals emphasized that CNH does not “mak[e] termination decisions uniformly.” Moreover, CNH’s approach to discounts was inconsistent and arbitrary, and that CNH’s approach unfairly disadvantaged small dealers like Chili.

The complaint further explains the alleged tying arrangement in that “CNH Capital’s own representatives have testified before this Court as follows: Capital is wholly owned by and is under the exclusive control of CNH Industrial America.  Both entities are wholly owned by and under the exclusive control of CNH Industrial, NV.  Every New Holland and Case dealer in the United States – more than 1000 dealers in total – is required to execute a wholesale financing and security agreement with CNH Capital in order to enter into a dealer agreement with CNH Industrial.  CNH Industrial does not, in the ordinary course of its business, accept payment from any party other than CNH Capital.”  “CNH Capital is the sole financier of all wholesale purchases of CNH Industrial America products.  Moreover, CNH Capital’s sole line of business is the financing of purchases of CNH Industrial products.  Based upon such testimony, it is an inescapable conclusion that CNH Capital’s sole reason for existence is to facilitate the sale of CNH Industrial America products, ergo it is absolutely integral to the wholesale distribution of such products.”

“Given CNH Industrial’s recent booking of a $500 million charge relating to the European Commission’s Cartel Investigation into their breach of Antitrust Regulations, combined with a rich history of inconsistent and capricious treatment of dealers like Chili Implement and Wootton New Holland, I am not at all surprised by their continued behavior. It would appear as though CNH Industrial feels that it can continue operate with impunity and drive toward their outcomes no matter the cost and free of consequence.” said Sean Raimbeault, CEO of Wootton New Holland, LLC.

The matter has also been referred to the Attorney General of The United States and is currently pending.

From September 26 to 30, the Simex 2016 simulation exercise was held in Bogotá, where Brash3D had the honor to carry out two applications to modernize and renovate the experience of the exercise of its sectorization activities. It made use of augmented reality and virtual reality for the UNGRD (National Unit for the Management of Risks and Disasters).

Thanks to Brash3D presence, they were able to update to the latest methods of visualization of sectorization activities, making use of innovations and state of the art technology, thus making Colombia the first host of the Simex that uses these technologies for this purpose throughout Latin America.

National and international participants met at Simex 2016, to put into action plans, procedures, protocols, and work methodologies to improve the response capabilities in case of an earthquake. This exercise is led by the United Nations, and an earthquake of magnitude 7.0 on the Richter scale was simulated.

This way, they also seek to improve the working skills with the international community, should a disaster require humanitarian aid.
