With 139,000 square-foot facilities, multiple auxiliary structures, and undeveloped land, the existing infrastructure provides a perfect atmosphere, with concrete walls and ceilings, for algae cultivation with minimal retrofitting.  Additionally, the high fences and razor-wire will offer unparalleled security for A2O and the other entities that will be co-locating on the undeveloped land.

New York City in Top 10 of Most “Robocalled” Cities in America

NEW YORK, NY – 2 Sep, 2016 – Consumers with 917 area-code phone numbers were bombarded with over 27.5 million Robocalls in the month of July 2016, according to a private company that tracks telemarketing, debt collection, and other Robocall activity nationwide.

The statistic – which made New York City the fifth most Robocalled city in the nation last month – accentuates what a challenging nuisance Robocalls pose to many average citizens.

A Robocall is any call made by an auto-dialing machine or program – in other words, any call made without a human finger actually dialing the number – and the recently released statistics demonstrate that their use is on the rise. 

The statistics were compiled by YouMail, a California-based developer of visual voicemail and Robocall blocking software.  YouMail estimates that, by the end of 2016, over 30 Billion Robocalls will have been made to phone numbers in the United States. 

It is becoming increasingly important that consumers are aware of their rights in this area in order to stop harassment and abuse. Luckily, consumer protection attorneys are increasingly cracking down on abusers of this solicitation and debt collection tactic.

Consumer Law attorney Brian Bromberg of New York City, who represents average citizens in these cases, said, “It is against the law for a company or entity to call your cell phone using an auto-dialer.  Whether the calls are from a debt collector or telemarketer, and whether they are abusive or not, is immaterial. If the calls were generated by an auto-dialer – and you have not given your express consent to receive those calls – they are illegal and you may be entitled to compensation.”

As a result of this ongoing nuisance, there have been recent pushes by legislators – working with phone companies – to prevent these annoying calls from getting through.  Any solution, however, will likely not arrive overnight and in the meantime, litigation is the strongest tool for protecting the public.  To discourage the practice, penalties for an illegal Robocall can be up to $1,500 per call.     

Mr. Bromberg highlighted the importance of keeping good records if you are receiving Robocalls and plan on bringing a lawsuit to halt the harassment.  “While we can get the relevant records from the offending company during a lawsuit, every little bit of information helps,” Bromberg said. “First thing you can do is contact your service provider and get your own phone records.  Second, you can make a list detailing the time, date, and number that has called you.  Don’t forget that missed calls count as well.  Accounting for every call is the best way we can maximize your recovery.”

Because many people don’t realize there is a remedy available to them, they may just get used to ignoring or hanging up on the constant calls.  However, if you receive an illegal Robocall to your cell phone, you could be entitled to an award of between $500 and $1,500 per call.  “These companies are breaking the law and many of them are getting away with it,” Bromberg said.  “As more lawsuits are brought against these offenders, they will start to feel it in their pocket books and hopefully that will lead them to change their behavior.”

An alphabet soup of confusing job titles and designations in the financial services industry has investors wondering exactly who does what. Different ethical and legal responsibilities are assigned to each. Choose wrong and it could cost—a lot.

HOUSTON, TX – 2 Sep, 2016 – A young mother described her horrifying circumstance to hushed crowd at a financial industry conference. She and her husband were proud parents of a precocious 2-year-old and she was nine months pregnant with their second child when her husband, a Navy pilot, was shot down and killed over Afghanistan.

She received a sizable check just weeks later, and blinded by grief, she immediately gave it to a financial professional. The conference host gently asked if it was a broker or advisor. The mother responded that she thought it was a financial advisor, but she wasn’t sure. [1]

Her answer isn’t unique. A plethora of terms and alphabet soup of designations and licenses has the investing public confused about who does what and the standards, both legally and ethically, to which they are held. Unfortunately, that confusion is actively encouraged by certain sectors of the financial services industry, according to regulators, something the Obama administration sought to address with the recent passing of the Department of Labor’s “Conflict of Interest” rule.

The rule requires financial advisors to act in the best interest of their client and to disclose any and all potential conflicts of interest, most specifically in how the advisor is compensated.

Traditionally, a recommended investment need only be suitable for a client’s particular situation; no longer, and a “fiduciary standard” is set to be implemented in 2017, a term that’s generated industry attention and debate for some time, but is now gaining greater awareness from the general public. The fiduciary rule states that the advisor must put the interests of their clients ahead of their own, and the financial product or service must be “the best” for their particular investment portfolio and financial plan.

The rule is not without controversy, and critics point to its vagueness in how the best investment for a client is determined and defined, something legal challenges will most likely determine.

While opponents argue over the burdensome nature of the rule, there are certain advisors that are already acting in a fiduciary capacity, and see the recent rule as a boon for their business, as well as a needed—and overdue—requirement for the industry as a whole.

“I am an independent financial advisor,” says Rocky Ghoneim, an Investment Advisor Representative (IAR) with Houston, Texas-based American Wealth Advisory, which offers a complimentary retirement kit. “That means I am not subject to the constraints of a large Wall Street firm. Too often, they have proprietary products that generate higher fees, and they will therefore recommend those to clients. We do not, and can recommend the product we feel is absolutely the best for the client, which means we have always acted as fiduciaries.”

Independent advisors such as Ghoneim point to what’s known as “open architecture,” industry jargon for a large supermarket-type of arrangement containing hundreds if not thousands of different investment products and services from which the advisor can choose. Financial firms and insurance companies enter into arrangements with these financial supermarkets, but the independent advisor is better equipped to tailor portfolios based on the client’s specific financial needs.

Surprisingly, prior to the DOL’s action, only about 1 percent of financial advisors were legally required to act in a fiduciary capacity. [2]

“Think of it this way,” Ghoneim concludes. “I develop retirement income plans for my clients. Too often, the financial industry seems to have a cookie-cutter approach; it’s a 60/40 or 70/30 stock to bond ratio for a client’s investment portfolio. That’s not a plan. Many companies are beholden to their shareholders. Well, my shareholders are my clients, and if I don’t act in their best interests as a fiduciary, I get fired.”

Since accumulating savings can often be challenging, a 2016 study by New York University’s Furman Center for Real Estate and Urban Policy stated that the overall number of rents outpaced inflation in the 11 largest U.S. metropolitan areas—except for the notable exception of Dallas and Houston, where they remained largely flat. “In Houston, just 41 percent of the population rented in 1970, but despite changes in wealth and employment, that number hit 54 percent by 2013,” said Hiles. “The idea that owning your home is the ultimate American Dream is being turned inside out.”
